Nairobi - Embakasi East MP Paul Ongili alias Babu Owino has found solace in a Bible verse after the Director of Public Prosecutions (DPP) appealed his acquittal in the shooting of Felix Orinda, alias DJ Evolve case.
On Friday, September 1, Assistant Director of Public Prosecutions Dorcas Rugut filed an appeal challenging Milimani Senior Principal Magistrate Bernard Ochoi's judgement to acquit the outspoken lawmaker over lack of evidence.
Following the appeal by DPP, the Embakasi East MP turned to the power of scripture for strength ahead of the hearing of the appeal.

The youthful politician took to his official social media accounts and shared a verse from John 16:33:
"I have told you these things, so that in Me you may have [perfect] peace and confidence. In this world you will have tribulation and trials and distress and frustration; but be of good cheer [take courage; be confident, certain, undaunted]! For I have overcome the world. [I have deprived it of power to harm you and have conquered it for you."
Meanwhile, Rugut raised six grounds on which she wants the judgment by Magistrate Ochoi set aside.
Among the issues raised by the prosecution is that Ochoi failed to consider the weight and credibility of the evidence the prosecution witnesses adduced.
"The learned trial magistrate erred in law and fact by acquitting the respondent without considering the weight of evidence and testimony adduced by the prosecution witnesses.

The DPP also raised the issue of the magistrate's interpretations of the ballistic report, which informed his decision to acquit the lawmaker.
"The learned trial magistrate erred in law and fact by finding that the ballistic expert report was inconclusive," the DPP stated.
Further, the DPP disputed the finding by the magistrate that there was no evidence of the victim having sustained gunshot wounds.
