Former KDF Officer Seeking Justice Stripped Naked In My Office, Ombudsman Florence Kajuju Tells MPs

Nairobi - The Chairperson of the Commission on Administrative Justice, Florence Kajuju, has narrated the challenges some members of the Kenya Defence Forces (KDF) go through.

How ex-KDF soldier got injured

Speaking after appearing before three joint parliamentary committees, Kajuju disclosed that some former KDF soldiers have been lamenting about mistreatment by senior officers.

Kajuju emotionally narrated how a former KDF officer stripped naked in her office to show her how he was denied justice despite getting injured while in the line of duty.

She disclosed that the soldier entered her office and stripped naked, showing her his partly burnt private parts.

"A retired soldier came to our office and demanded to see me, and he stripped. He had some disability, 45% burns on his private parts. I did know what to do. He said when he went to war, an explosive messed up his private parts," Kajuju narrated.

Kajuju stated that instead of KDF supporting the soldier after getting injured, they allegedly retired him.

"And he said he had not received justice. Instead, he was retired from the Kenya Defence Forces. He thought he would get justice by showing me the disability," she added.

She spoke before the Committees on Justice and Legal Affairs, Defence, Intelligence, and Foreign Relations and Delegated Legislation, advocating for establishing the office of military ombudsman.

Kajuju said her proposal to have an internal military ombudsman in Kenya who will ensure that KDF operates with integrity, handles individual complaints, helps prevent human rights abuses, eliminates malpractice, and contributes to the overall good governance of the security sector.

“The Commission has received 289 complaints as of June 2023, from current and former members of the Kenya Defence Forces, particularly on matters of promotion and, termination among others. We propose to have an Internal Military Ombudsman, who will deal with these disputes in a fair and just manner," she asserted

Ex-KDF officer Peter Mugure wins case

In other news, the Employment and Labour Court awarded former KDF officer Peter Mugure KSh 2 million for what it termed as unlawful dismissal from the force.

Mugure, a former major in the Kenya Air Force, has been behind bars at the King'ong'o Maximum Prison after being charged with the murder of his wife and two children in 2019.

According to a report by the Daily Nation, Nyeri Employment and Labour Court Judge Onesmus Makau ruled that the murder suspect's dismissal was unfair and unlawful, adding that he is entitled to termination benefits.

The judge also ordered that Mugure be compensated further for any injuries he sustained during his service.

"A declaration that the termination of his commission was unfair, unlawful and unconstitutional. as it was done in breach of express provisions of the law," the judge said in his verdict.
In the foregoing, if find that accused conditional rights were trumped upon I therefore make the following order that the accused is entitled to his termination benefits including pension," he ruled.
