Shitubi released Wanjigi on a personal bond of KSh 10 million until September 12, when a decision will be made on the charges against him.
The magistrate further ordered the Safina Party leader to deposit his passport in court pending her ruling.
Wanjigi, through his lawyers including Senior Counsel Paul Muite, Kalonzo Musyoka, and Willis Otieno, applied to have the plea taking deferred, claiming their client's rights had been violated.
They argued that police defied a court order issued by Justice Bahati Mwamuye, stopping his arrest and detention.
Speaking after his release, Wanjigi accused President William Ruto's administration of unfairly targeting him.
Wanjigi was apprehended on Monday, August 19, at the Directorate of Criminal Investigations (DCI)'s Milimani office after honouring police summons.
The billionaire went to record a statement over his alleged funding of the anti-government protests but was arrested.
The police said the arrest had nothing to do with an earlier probe on the Nane Nane protests but was related to six rifles found in Wanjigi's home.
According to the police, the Firearms Licensing Board said that the six rifles found in Wanjigi's house were not licensed.
Wanjigi's arrest saw several political leaders accuse the state of ignoring court orders.
Kalonzo, who visited the politician at Kamukunji police station, described the arrest as unconstitutional.
