The Kenyan government has proposed new regulations for President William Ruto's flagship affordable housing programme.

Why defaulters risk losing houses

If passed into law, homeowners will be required to make their payments on time, and failure to do so will result in their house being repossessed.

This is according to Affordable Housing Regulations 2024 drafted by the Ministry of Lands, Public Works, Housing and Urban Development.

If a person fails to pay an outstanding amount for four consecutive months, he/she will be deemed a defaulter.

"Where a person fails to remedy the default as required under sub-regulation (2) for four consecutive months, the Affordable Housing Board shall take possession of the affordable housing unit," the regulations state.

Alternatively, the government may reallocate the affordable housing unit to another eligible person or may change the person’s affordable housing unit to a lower-value unit.

The board may also enter into a restructuring arrangement with the person in default.

Which housing categories are under the programme?

The Affordable Housing Act 2024 established four distinct categories of affordable housing:

1. Social housing unit

This category is intended for individuals whose monthly income falls below KSh 20,000.

2. Affordable housing unit

These houses are for individuals whose monthly income ranges from KSh 20,000 to KSh 149,000. The majority of Kenyan salaried Kenyans fall in this category.

3. Affordable Middle-Class Housing Unit

This housing category is for individuals with a monthly income exceeding KSh 149,000, and this category seeks to cater to the housing needs of the middle-class population.

4. Rural Affordable Housing Unit

These houses target individuals residing in non-urban areas to provide housing solutions suitable for rural settings.

  • Ruto said hustlers will own houses by paying as little as KSh 3,000 monthly rent.
  • The president vowed to continue with the Affordable Housing Scheme despite resistance from a section of Kenyans.
